Who we are

This website, at southamericawineguide.com, is operated by Amanda Barnes, from South America Wine Guide, who is the data controller for the personal information described in this policy.

What this policy covers

This policy explains what personal information we collect when you use this website, why we collect it, who we share it with, how long we keep it, and what rights you have over it. It applies to our sign-up forms, our shop, and the rest of this website.

The information we collect

When you sign up for a report or the newsletter. Your email address, and your first name if you choose to give it. Nothing else is required.

When you buy something from us. Your name, email address, billing and delivery address, and the details of your order. Card payments are handled entirely by our payment provider and your card details never reach us or this website.

When you use the site. Standard technical information such as your browser type and the pages you visit, collected through cookies. See the cookies section below.

When you vote in a public poll. Nothing. Our voting feature records only the running total for each option. It does not record who voted, and no names or email addresses are stored.

Why we collect it, and our legal basis

To send you reports and newsletters you have asked for. Our legal basis is your consent. You give it by ticking the box or entering your address on a sign-up form, and you can withdraw it at any time.

To fulfil your order. Our legal basis is performance of a contract with you. We cannot send you a book, deliver a download or publish a listing without it.

To keep records we are legally required to keep, such as sales records for tax purposes. Our legal basis is compliance with a legal obligation.

To keep the site working, secure and useful. Our legal basis is our legitimate interests in running and improving the site, balanced against your rights.

Marketing emails

We only send marketing emails to people who have asked to receive them, or who have bought something from us and were given the choice to opt out at the time.

Every email we send carries an unsubscribe link. One click and you are removed, and we will not email you again unless you sign up afresh. You can also simply reply to any of our emails and ask.

We do not sell, rent or trade email addresses. We do not share them with other companies for their own marketing.

Who we share your information with

We use a small number of trusted services to run the site. They act on our instructions and may only use your information to provide their service to us.

Our email platform, which stores our mailing list and sends our newsletters and report downloads.

Our shop platform, which processes orders, payments and customer accounts.

Our website host, which stores the site itself.

Our technical partner, Wine with Margot, who builds and maintains the site for us under a written agreement that requires her to keep your data secure, to use it only on our instructions, and to delete or return it when it is no longer needed.

We may also disclose information where the law requires it.

Where your information is held

Some of the services above are based outside the United Kingdom, including in the United States. Where information is transferred outside the UK, we rely on the safeguards permitted by UK data protection law, which may include the UK International Data Transfer Agreement, the UK Addendum to the European Commission’s standard contractual clauses, or a finding of adequacy for the country concerned.

How long we keep it

Mailing list. Until you unsubscribe, or until you have not opened or clicked any of our emails for 24 months, after which we remove you.

Orders and customer records. For 6 years, which is the period UK tax law requires us to keep business records.

Website analytics. For 14 months.

Your rights

Under UK data protection law you have the right to:

  • ask us for a copy of the personal information we hold about you
  • ask us to correct anything that is wrong
  • ask us to delete it
  • ask us to stop or limit how we use it
  • object to us using it, including for marketing
  • ask us to transfer it to you or to someone else in a portable format
  • withdraw your consent at any time, where consent is what we relied on

To do any of these, email contact@southamericawineguide.com. We will respond within one month. There is no charge.

Cookies

This site uses cookies. Some are necessary to make it work, such as remembering what is in your basket or that you have already voted in a poll. Others help us understand how the site is used, and these are only set if you agree to them.

You can change your cookie choices at any time through the cookie settings on this site, or through your browser settings.

Children

This site is about wine and is intended for adults. We do not knowingly collect personal information from anyone under 18.

Changes to this policy

If we change this policy we will publish the new version here and update the date below. Where a change is significant and affects how we use information you have already given us, we will tell you by email.

Complaints

If you are unhappy with how we have handled your personal information, please tell us first at contact@southamericawineguide.com and we will try to put it right.

You also have the right to complain to the Information Commissioner’s Office, the UK’s data protection regulator, at ico.org.uk, by calling 0303 123 1113, or by writing to Information Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF.
